For your convenience, we would like to give you a summary below about the most important changes, and the reasons behind them:
1. Recently, we have acquired Globalese, the developer of a powerful platform of AI-powered, custom neural machine translation
models (see the press release here). To follow up on that acquisition, we are inserting new provisions into our GToS (see e.g.
section 4.c and chapter VI). The new provisions create the legal background for our expanded range of automated translation
services. In the future, these will include not only memoQ AGT (our generative AI-based translation automation solution), but
also the training and deployment of custom, domain-adapted and AI-powered machine translation engines, in the framework of
the globalese by memoQ solution.
2. We are also introducing new subscription plans for memoQ TMS, our translation management system. We are making this
update to better align our offerings with the needs of our customers. To create the legal background, we are modifying chapters
V and VI of our GToS. Previously, these chapters regulated various aspects of the memoQ TMS service separately, and included
many technical details. The new chapter V will contain all the provisions related to memoQ TMS in a more simplified format.
Technical details, and the details of the subscription plans, will be accessible from separate documents, referenced in the GToS
(see sections 17 and 24), to keep the legal text neat and comprehensible.
3. Despite the introduction of new plans, we will of course keep your existing setup unchanged during your current subscription,
license period, or SMA period, at least until the next renewal date (see section 23). If you are affected by the change and your
renewal date is approaching, please make sure to contact your Account Manager directly, or write an email
to sales@memoq.com. We are here to assist you in any way we can.
4. We are modifying several parts of our GToS to make clear that we provide support, and we ensure security, data integrity,
backups and a pre-defined level of availability, also in respect of our new services related to machine translation engines.
5. The new terms will provide you with more rights, clarity and flexibility when it comes to the termination of a subscription (see,
in particular, section 108) and future modifications of the GToS (see sections 132 and 14).
6. As regards general rules of subscriptions, we clarify how you can modify your subscription, and shorten the 5-day grace period
before the suspension of a subscription in case of non-payment to 3 days (see section 15).
7. In general, we are simplifying the terminology and making the legal text more accessible and shorter for you. We align the
wording with the new provisions (see points 1-2 above) across the whole document.
8. As we plan to discontinue the Language Terminal portal and its services, we are removing the relevant chapter from the GToS.
The portal remains available at least until January 22, 2025, but please make sure to download a copy of your data before that
date, if you are affected. The terms concerning Language Terminal will be available from a separate document under
memoq.codeva-dev.hu/legal.
9. As memoQ AGT is no longer in an experimental phase but became part of our regular offering (available as an add-on), we will
get rid of the separate AGT Terms of Service. The relevant provisions will be transferred, in a simplified form, to chapter VI of the
GToS.
10. We are updating the list of our data sub-processors, for better transparency (see section 146).
Apart from editorial changes, the following sections were updated:
– section 39.a, because henceforth we undertake to provide round-the-clock support service on weekdays;
– section 124, to align the text with the exact wording used in the GDPR.
